Terms of Service

1. Acceptance of Terms
By accessing or using Fly-Wise ("Service"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree, please stop using the Service immediately. We may update these terms periodically — continued use constitutes acceptance.
2. What Fly-Wise Does
Fly-Wise is an AI-powered travel assistant that helps you search, compare, and book flights. We use artificial intelligence to provide price predictions, travel recommendations, visa guidance, insurance suggestions, and automated booking. Fly-Wise acts as a technology intermediary — actual flight bookings are fulfilled through airline partners via Duffel API. We do not operate airlines or issue tickets directly.
3. Eligibility & Accounts
You must be at least 18 years old and have the legal capacity to enter into a binding contract to create an account. You agree to provide accurate, current, and complete registration information and to keep it up to date. You are solely responsible for all activity conducted under your account and for maintaining the confidentiality of your credentials. Notify us immediately at legal@flywisely.net if you become aware of any unauthorized access to or use of your account.
4. Bookings & Payments
When you book a flight through Fly-Wise, you enter into a contract directly with the airline — not with Fly-Wise. Prices shown are subject to real-time availability and may change until payment is confirmed. We are not responsible for airline cancellations, delays, schedule changes, or denied boarding. Refund eligibility is governed by the airline's specific fare rules, which are displayed at the time of booking. Service fees charged by Fly-Wise are non-refundable.
5. AI Price Alerts & Auto-Booking
When you enable "auto-book" on a price alert, you grant Fly-Wise explicit authorization to complete a flight booking on your behalf when your target price is matched. A confirmation email will be sent to you immediately after booking. You may cancel within 24 hours subject to the applicable fare rules. Fly-Wise bears no liability for bookings that are non-refundable per airline policy. You can disable auto-book at any time from your Alerts page.
6. Fly-Wise Credits & Rewards
Fly-Wise Credits ("Credits") are virtual rewards issued for referrals, promotions, and account milestones. Credits hold no monetary or cash value, are non-transferable, and cannot be exchanged for money. Credits expire 24 months after issuance. Fly-Wise reserves the right to modify or terminate the credits program with 30 days notice.
7. AI-Generated Content Disclaimer
Our AI provides travel recommendations, visa information, price predictions, risk assessments, and insurance suggestions. This content is for informational purposes only and may not be 100% accurate or current. Always verify visa and entry requirements with official government/embassy sources before travelling. Price predictions are estimates based on historical patterns and are not guarantees. Insurance recommendations do not constitute professional financial or insurance advice.
8. Privacy
Your use of Fly-Wise is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection, use, and processing of your personal data as described in the Privacy Policy.
9. Prohibited Conduct
You may not: (a) use the Service for any unlawful purpose or in violation of any applicable laws; (b) attempt to gain unauthorized access to our systems, APIs, or other users' accounts; (c) use automated scraping tools, bots, or crawlers; (d) submit false, fraudulent, or misleading booking information; (e) resell or commercially exploit the Service without prior written authorization; (f) transmit spam, malware, or harmful code; (g) harass, threaten, or abuse our team or other users. Violations may result in immediate account termination and legal action.
10. Intellectual Property
All elements of the Fly-Wise platform — including AI models, algorithms, software, designs, trademarks, and content — are the exclusive property of Fly-Wise AI Ltd or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal travel purposes only. You may not copy, modify, reverse-engineer, decompile, or create derivative works from any part of our platform.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Fly-Wise AI Ltd and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, revenue, profits, or goodwill — arising out of your use of the Service. Our total aggregate liability to you for any claim shall not exceed the total fees you paid to Fly-Wise in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless Fly-Wise AI Ltd and its affiliates from and against any claims, damages, losses, liabilities, and costs (including reasonable legal fees) arising out of: your use of the Service; your violation of these Terms; your violation of any third-party rights; or any content you submit through the Service.
13. Termination
We reserve the right to suspend or terminate your account at any time for violations of these Terms, fraudulent or unlawful activity, or where required by law, with reasonable notice except where immediate action is necessary to protect the Service, other users, or third parties. You may close your account at any time by contacting legal@flywisely.net. Upon termination, your right to use the Service ceases immediately and any outstanding Credits are forfeited.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or an in-app notification at least 14 days before taking effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
15. Governing Law & Disputes
These Terms are governed by and construed in accordance with applicable law. Any dispute arising from or relating to these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration, except where prohibited by local law. Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction.
